Axe Throwing Waiver

This agreement is just for you. You may also use this form to on behalf of anybody under the age of 18 who is under your supervision.  You will be responsible for yourself and those of whom you are supervising.

ON POINT ARCHERY LTD – AXE THROWING DISCLAIMER FOR PERSONAL AND THIRD PARTY INJURY AND/OR DEATH

1. Important Notice
1.1 Axe throwing is a physically challenging and potentially dangerous activity which carries with it risks that we cannot entirely eliminate. These include the direct risk of personal injury and, in extreme cases, death caused by handling and throwing the axe. Examples of personal injury include, but are not limited to, bruises, cuts, other soft tissue damage, broken bones, psychological injury and paralysis.
1.2 A parent or legal guardian must counter-sign this statement on behalf of minors.
1.3 It is important that you read and understand this statement before signing. If there is any term that you do not understand, then please discuss it with us before signing.

2. RULES
2.1 You must act responsibly and sensibly at all times. 
2.2 Children under the age of 10 are strictly prohibited from participating in the activity. 
2.3 A responsible adult over the age of 18 must consent and counter-sign this statement on behalf of minors, and accepts full responsibility for the way that child conducts their self during the activity.
2.4 You must not participate if you are under the influence of alcohol, any drugs which may impair your ability to operate machinery including non-prescription drugs.
2.5 You must follow any safety warnings or instructions displayed or given to you by a member of staff (ask a member of staff if you are unclear), in addition to reading the safety brief on our website.
2.6 In an event where there is a breach of health and safety on the range our instructors may shout stop. It is your responsibility to assure that you do not let go of the axe and that you maintain control of it at all times. 
2.7 It is ALSO your responsibility to stop if you notice a breach of health and safety on the range. This could be that somebody has walked onto the range or that there is somebody near the backstop net.

3. Restrictions
3.1 You are responsible to determine if you are fit to safely take part in axe throwing. ON POINT ARCHERY LTD are not qualified to determine this, however we can advise on the physical requirements of the activity. Please seek medical advice prior to your session to ensure you are physically fit enough to participate.
3.2 You acknowledge that you are not affected by any of the below restrictions and confirm that you have informed a member of the ON POINT ARCHERY LTD team if you are. The following persons are not allowed to participate in axe throwing: * anyone who appears intoxicated through alcohol, drugs or any other intoxicating substance; * anyone who is pregnant; * anyone who has had an operation within the past 12 months that, through participating, the object of the operation could be aggravated; * anyone undergoing medical treatment for an ailment that may be aggravated, including but not limited to, high blood pressure, epilepsy, back problems, neck problems or any heart condition; or * anyone suffering from any other known condition that may be aggravated.

4. Use of Equipment
4.1 You are responsible for using equipment safely and as directed. 
4.2 You must behave sensibly and follow any safety instructions so as not to hurt or injure yourself or others. * It is your responsibility to make sure that you fully understand how to use the equipment prior to participating, and to ask for extra support if you need it.

5. Waiver of Liability
5.1 In the absence of any negligence or other breach of duty by us, the use of our equipment, facility and the undertaking of the activity itself is entirely at your own risk.
5.2 You acknowledge that the activity is potentially dangerous and that by participating in the activity you are exposing yourself to the possibility of personal injury and, in extreme cases, death.
5.3 You acknowledge that you have read and understood the safety briefing on our website prior to participating in the activity.
5.4 You confirm that you are fit to participate in the activity and that you have disclosed to us all and any medical history which may indicate the contrary, and sought a specialist’s opinion where necessary. We shall not be liable for consequences arising out of your failure to do so.
5.5 Nothing in this disclaimer will exclude or limit liability in respect of any matter which it would be illegal or unlawful for us to exclude or limit, or to attempt or purport to exclude or limit.
5.6 You confirm that you recognise an axe is potentially dangerous and used wrongly can cause serious harm and in extreme cases death.
5.7 It is your responsibility to be vigilant and aware of any changes to the health and safety on the range (for example this may be people walking across the range or too close for comfort for you to throw your axe).  If you’re unsure whether its safe to proceed then it’s your responsibility to wait until you’re confident that it is safe before continuing.
5.8 By completing the form below you agree that any children that you’re signing for are over the age of 10 and under the age of 18, and you take full responsibility for them for the duration of the event – meaning that the wording in this document applies to YOU for the children that you’re supervising as well as yourself.

By signing this waiver you accept the responsibility (for yourself and any children you’re supervising) for anything that happens whilst you (or a supervised child) has control of an axe, should something or someone come in harms way during the participation in the sport. It is your responsibility to ask our instructors for extra help should you need it or if there is anything you do not understand BEFORE participating in the sport.

6. Indemnity
6.1 You shall indemnify us (ON POINT ARCHERY LTD) against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other professional costs and expenses) suffered or incurred by us arising out of or in connection with any claim made against us by a third party arising out of or in connection with your carrying out of the activity of axe throwing through our business, to the extent that such claim arises out of your breach, negligence, recklessness or other action resulting in a third party’s claim against us.

By checking here, you acknowledge you have read and understand the above terms, and are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
